Moore of the University of Illinois, who will present: “Moral Combat and the Hohfeldian Analysis of Active Rights”, coauthored with Heidi Hurd. This is a pre-read seminar. Abstract: Hurd and Moore restate the central theses of Hohfeld, emphasizing their clarity, systemeticity, originality, and importance to both legal and moral analysis, and then raise questions about Hohfeld’s schema and detail an alternative schema long ago put forward by Hurd following what may broadly be called the Kantian tradition.
